General Terms and Conditions of Sale and Premium Subscription (GTC)

1. Publisher identity

2. Purpose
These GTC define the terms and conditions for subscribing to, using, and terminating the Premium offer of the Flarasa application.
3. Definitions
- Application: Flarasa mobile application.
- Standard Offer: free offer with limited features.
- Premium Offer: paid offer with extended features.
- Store: Apple App Store or Google Play Store.
- User: any natural person of legal age acting for non-professional purposes.
4. Scope
These GTC apply to any subscription to the Premium Offer. Subscribing implies full and unconditional acceptance of these GTC. Store terms and conditions also apply to the payment transaction.
5. Account creation and access
Access to the service requires a valid user account. The User agrees to provide accurate information and keep it up to date. The User is responsible for the confidentiality of their login credentials.
6. Offers and features
The Standard Offer and Premium Offer provide access to different features. In V1:
- Standard: maximum 5 lists.
- Premium: maximum 20 lists.
The publisher may evolve features, provided that it does not deprive the User of rights already acquired for the current paid period.
7. Pricing
Premium Offer prices are displayed in the Application via the Store, in local currency and including all applicable taxes. Applicable prices are those displayed at the time of subscription.
8. Subscription and payment
Subscription is made via the Store. Payment is charged by the Store under its own terms and conditions. The User acknowledges their payment obligation upon subscription validation.
9. Term, renewal and termination
The subscription is entered into for the selected period (monthly or yearly) and automatically renews unless terminated. Termination can be made at any time from the Store subscription settings. Termination takes effect at the end of the current period, unless the Store terms or applicable law provide more favorable provisions. When Premium expires, the account switches back to Standard. User data (including existing lists) is not automatically deleted; creation of new lists becomes subject again to the Standard quota.
10. Right of withdrawal
In accordance with consumer law, consumers generally have a 14-day withdrawal period. The User may request immediate performance of the service before the end of this period. Where applicable, the User is informed that withdrawal may result in payment of a proportional amount for services already performed. Where the service consists of digital content without a physical medium and starts immediately with express consent and acknowledgment, the right of withdrawal may be lost according to applicable legal conditions. Refund requests initiated through a Store are also subject to that Store's policies.
11. Statutory warranties
The publisher is bound by applicable statutory warranties, including legal conformity warranties for digital content and digital services.
12. User obligations
The User agrees to:
- use the Application in accordance with its intended purpose;
- not impair the proper functioning or security of the service;
- not bypass technical or access limitations.
13. Service availability
The publisher makes reasonable efforts to ensure service availability. Interruptions may occur, in particular for maintenance, security, or force majeure reasons. No temporary unavailability shall engage the publisher's liability beyond mandatory legal provisions.
14. Liability
The publisher is liable within the limits provided by law. The User remains responsible for their equipment, internet connection, and use of their account.
15. Intellectual property
All elements of the Application (trademarks, texts, graphics, software, databases) are protected. Any unauthorized reproduction or use is prohibited.

17. Complaints and mediation
For any complaint: support@flarasa.com In accordance with consumer law provisions, the User may refer the matter free of charge to a consumer mediator after a written complaint has remained unresolved.

18. Changes to the GTC
The publisher may modify these GTC. The applicable version is the one in force on the subscription or renewal date, unless otherwise required by law.
19. Applicable law and disputes
These GTC are governed by French law. In the event of a dispute, competent courts are determined in accordance with applicable legal rules.
